* TWO-PARTER... (Part 1 of 2)

http://www.washingtontimes.com/news/2014/jul/15/obama-executive-actions-seen-as-threat-to-constitu/?page=all#pagebreak

A prominent law professor and avowed supporter of the Obama White House will tell the House on Wednesday that the president has created one of the biggest Constitutional crises in the country’s history... and will endorse House Republicans’ effort to sue to rein him in.

Jonathan Turley, a professor at George Washington University, will say President Obama is trampling the Founders’ vision for the country in his push to circumvent Congress, and he will demand Republicans and Democrats alike forget their party labels to unify against this White House’s power grab.

“What we are witnessing today is one of the greatest challenges to our constitutional system in the history of this country,” Mr. Turley said in a prepared testimony, saying it began with previous presidents but under Mr. Obama has “reached a Constitutional tipping point that threatens a fundamental change in how our country is governed.”

The scorching testimony to the House Committee on Rules kicks off what’s expected to be a several-week push by Republicans that will end in the House approving a lawsuit against Mr. Obama, challenging his unilateral decision to ignore or waive parts of his own signature health care law.

Some conservative commenters have opposed the House GOP’s effort, saying Republicans should use the tools the Constitution gives them — chiefly the power of the purse — to fight back against Mr. Obama’s claims of executive authority. But Republicans, who control the House, have run up against roadblocks in the Democratic-controlled Senate. They want the courts to intervene in part to elevate the fight above election politics and help recalibrate a balance of powers that’s skewed deeply toward the White House in recent decades.

The legislation Republicans plan to push through the House would authorize a lawsuit challenging ObamaCare’s so-called employer mandate, which required all medium-size and large businesses to provide insurance to their employees by this year or else face stiff penalties. Claiming prosecutorial discretion, Mr. Obama waived the deadline and penalties.

Republicans argue the law didn’t give Mr. Obama any leeway to issue a waiver, and they said they have no recourse but to ask the courts to step in.

But...

* AND HERE'S THE DEAL, FOLKS...

...judges have traditionally been reluctant to get involved unless a party can show it’s sustained an actual injury.

* CONCLUDING... (Part 2 of 2)

Walter Dellinger, a former top Clinton administration lawyer, will tell the House Committee on Rules that the court’s reluctance is part of the Founders’ vision and said it’s a mistake to beg them to take a more active role when the dispute is over routine decisions such as enforcing the employer mandate.

“Never in our history has such a radical change in the role of the judiciary been proposed to deal with such a routine question of administrative process,” he said in his prepared testimony.

He said Congress writes these kinds of laws assuming the administration has the discretion to decide how and when to enforce them.

Democrats on Capitol Hill question why most Republicans remained silent when President George W. Bush made expansive claims of executive power and are only now outraged at Mr. Obama.

* AND...

Some Obama administration officials have hinted that the president’s race may play a role.

Mr. Turley said he doesn’t believe Mr. Obama has tyrannical impulses or that he’s intentionally trying to subvert the Founders’ vision of separation of powers.

He said blame should be spread across all three branches of government: a White House eager to ignore rules in order to get things done, a Congress too weak and riven with partisan divisions to assert itself against presidents of either party, and judges who are unwilling to play the role of referees the Founders envisioned.

Mr. Turley said he expects the lower courts to duck the fight, ruling Congress doesn’t have standing to sue since lawmakers aren’t suffering an actual injury as the court sees it.

But he urged the House to continue to press, with the Supreme Court likely to eventually get involved, where he hoped the justices would oppose Mr. Obama and reaffirm what he said the Founders envisioned.

“It is tempting to embrace rule by a single person who offers to govern alone to get things done. However, this is the very siren’s call that our Founders warned us to resist,” he said. “We remain a nation of laws, and we have a court system designed to resolve such controversies.”

http://www.breitbart.com/Big-Government/2014/07/15/House-Dems-Push-Amnesty-on-Twitter-America-s-Doors-Are-Open

As thousands of illegal immigrant children are crossing the U.S.-Mexico border, House Democrats pushed for more amnesty, guest-worker visas, $3.7 billion in funding, and more lawyers for illegal immigrant children during a Tuesday Twitter town hall on immigration.

Their message to illegal immigrants was, in the words of Rep. John Lewis (D-GA), "our doors are open."

* INSANITY! THESE... ARE... THE... DEMOCRATS!

"We are all connected. We can't just build a wall or a fence and say no more," Lewis said. "This is America. Our doors are open."

* AND THIS GUYS IS A SENIOR... POWERFUL... DEMOCRAT!

Reps. Tammy Duckworth (D-IL) and Steve Horsford (D-NV) pushed for more guest-worker visas - which are coveted by big-business and high-tech interests - that would lower the wages of American workers.

(Numerous scholars and studies have concluded that America has a surplus – not a shortage – of high-tech workers.)

* BUT PUTTING THAT ASIDE, FOR CHRIST'S SAKE, THERE'S SIMPLY NO DEBATE ABOUT OUR NOT NEEDING ANY MORE UNSKILLED LABOR!

Rep. Judy Chu (D-CA) said taxpayers should pay for more lawyers for illegal immigrant children, and Rep. Zoe Lofgren (D-CA) went further, saying "every" illegal immigrant child should get legal representation.

* FOLKS... AS BAD AS THE REPUBLICANS ARE... THE DEMOCRATS ARE DELIBERATELY ATTEMPTING TO "BREAK" AMERICA. (AND THEY'RE SUCCEEDING!)

Rep. Charlie Rangel (D-NY) insisted that amnesty legislation would "raise wages" even though the Congressional Budget Office determined that the influx of more foreign workers would lower the wages of American workers.

* RANGEL... DOESN'T... CARE...!!! (EITHER THAT OR HE'S SENILE...)

For that reason, U.S. Civil Rights Commissioner Peter Kirsanow wrote a letter to the Congressional Black Caucus urging them to vote against amnesty bills that would detrimentally impact black Americans at the lower rungs of the economic ladder the most.

* POOR BLACKS... POOR WHITES... WHAT MATTERS IS CITIZENSHIP... AMERICANS FIRST AND FOREMOST!

At least 57,000 illegal immigrants have crossed the border since October of last year, and federal officials expect at least 150,000 more to do so next year. Obama has requested $3.7 billion in emergency funds from Congress to deal with border crisis.

* AND BY "DEAL" HE MEANS CONTINUING TO DO JUST WHAT HE'S BEEN DOING!

http://www.nationalreview.com/corner/382911/former-border-patrol-deputy-chief-all-good-was-done-after-911-now-has-been-reversed

Former national deputy chief of the U.S. Border Patrol Ronald Colburn tells National Review Online that the Obama administration has undone all of the progress made at America’s southern border since 9/11.

“We’re back to a pre-9/11 situation basically, and this administration did that in the past five years,” he says. “All of the good that was done after 9/11 up to now has been reversed singlehandedly.”

Colburn, who spent more than 30 years working for U.S. Customs and Border Protection, says the resulting national-security risk has to do with the “clutter” of people at the border. He says all of the gains made since 9/11 came as a result of reducing the number of people crossing the border.

The Border Patrol’s task is to sort through the haystack of people as they come across, he says. “What this situation on the border is doing is growing the haystack, is adding clutter, so that those dangerous needles get through because we’re tied up capturing, instead, juvenile children from Guatemala and El Salvador,” he says. “When you see the cartels — the Zetas and MS-13 and the Gulf Cartel — laughing about this on the Internet, you know what’s behind it.”

Colburn says the “gangsters down south” enjoy social media, taking selfies, and talking about one another online. Border Patrol officials monitor the cartels’ online communications along with officials from the Department of Defense and intelligence community, he says.

http://www.breitbart.com/Breitbart-Texas/2014/07/16/Exclusive-Released-Alien-from-Border-Crisis-Arrested-For-Alleged-Murder-Kidnapping-in-Texas

An illegal immigrant who was released by U.S. authorities with a Notice to Appear has been arrested for the alleged murder of a woman and kidnapping of children on U.S. soil.

The alleged crimes occurred after the man was released.

The man, Pedro Alberto Monterroso-Navas, entered the U.S. illegally with children and turned himself in to U.S. Border Patrol agents. He was processed and released as are all illegal immigrants who come as unaccompanied minors or incomplete family units from Central America. The alien is from Honduras.

The arrest was first reported by the Associated Press (AP), but Breitbart Texas has exclusively confirmed that the man was part of the Obama Administration’s catch and release policy for family groups from Central America.

A U.S. Border Patrol source who spoke with Breitbart Texas on the condition of anonymity provided Breitbart Texas with the alien registration number for the man and the event number for the man’s apprehension.

He was processed in the McAllen station of the U.S. Border Patrol. The alien’s registration number is 202027386. The event number for his apprehension is MCS14061487. The “MCS” designates the McAllen station, the “1406” designates that the man was apprehended in June of 2014. A separate Border Patrol source confirmed that the man was apprehended on June 26, 2014 with two children he claimed were his own. He told U.S. authorities he had family in Metairie, Louisiana.

The AP identified the illegal alien as a “suburban New Orleans man” who faces a second-degree murder charge after his girlfriend was found bludgeoned to death in a bathtub in Louisiana.

The man was arrested in a Katy, Texas trailer park with three children. It is unclear if they are his or if they are the same children he used to get U.S. authorities to release him with a Notice to Appear.

The AP did not inform their readers that the man was an illegal alien.
